Bankruptcy and income tax?

My husband and I are on the verge of filing ch. 7 bankruptcy. We decided it was our last option about 9 months ago and met with an attorney. One question that has come up since that meeting is if filing will affect our next income tax return. (not receiving anything in return, only getting a portion, would the income tax filing be different ect ect.) The attorney is very hard to get a hold of other wise I would just ask him. I thought I might ask here first, then last resort, talk with the attorney. Please help if you know anything on the subject.

Tax return and back child support!?

Federal Tax Question – Is it A Rental Property?

I inheritied my fathers residence in 2005 when he passed away. One of his requests was that his then girlfriend be allowed to remain in the residence rent free. The attorney that handled the estate setup an agreement that she would be able to remain in the house rent free for 5 years, she signed a lease, etc. The lease reflects $0 annual rental payments.

My question is can I still treat this property as a rental and take advantage of all of the tax benefits that accrue? I know there has to be an effort made to rent and there are issues if the rent charged is below the average rent for your area. Worst case I guess would be I can only deduct property taxes paid but not homeowners insurance, depreciation, etc…

Next question – I have recently paid said individual a sum of money and in return she has terminated the lease agreement and has moved out of the residence. Can I deduct the early lease termination payment I made to her from my income?

Attorney made error on Chapter 13 payments?

My husband and I filed Chapter 13 in 2006. Prior to that the attorney asked us to check if we would have a tax refund coming.
My husband found out that we would have a large tax refund coming. The attorney told us to adjust our tax allowances so that we would not have any refund. The reason was that any refund would go to the bankruptcy court. Our bankruptcy payments are based on the higher allowances. I was doing our federal tax filing last night when I realized that we now owe the government over $3000 in taxes because not enough money was taken out of my husband’s paychecks. We are barely making ends meet now. There is no way that we’ll be able to afford another $400 a month taken out for taxes. They are to base our payments with disposible income. I believe that paying our taxes is not considered disposible. Should I contact my attorney and ask for the payments to be readjusted? We are paying over $350 a week now. Last year, we paid over $18000 to the court.

Should I get an attorney to help settle my back taxes or should I work it out on my own?

It’s kind of a catch 22 because I need to start the business so I can make money to pay them but on the other hand, I’m afraid to start it because I’m afraid they might be able to take it, or all of the profit it makes, including my friend’s half. I could deal with them taking my half of the profit but if they take my friend’s half(not sure if they can do that?) he would not be pleased to say the least.
