This is the first year that the Attorney General’s office flagged my wife’s ex to intercept his tax return for back child support. If he gets a RAL (Rapid Anticipation Loan) check will the IRS still send the refund to her?

He wont get a RAL
The IRS will have flagged that return and thus RAL will be rejected
She will get the check

Yes. The RAL money is a loan from the bank the tax place does business with. He will not get the return and he will have to pay back the RAL

The IRS does not send him a RAL, a private bank does. It is a loan.
The IRS will send your wife the back child support.
The bank that made the RAL loan will go after her Ex for the full amount of the loan when they find out the child support has been deducted.

She’ll get the refund- He can’t get RAL approval if he’s flagged- Most companies verify info with IRS for approval from IRS- Otherwise, he’ll just have to pay it back with interest like any other loan

First of all, most places check before releasing an RAL, so he should not be able to get one. Second, the money will clear from the Irs depending on if he is married or single differently. If he is married, they have to give his spouse time to file for injured spouse. the IRS can hold the money for upto 6 months if there is a possibility someone will file for injured spouse, then it would be cleared to the agency that filed the intercept. They will have to issue her the check not the IRS.

I Agree With Elizabeth P She Is So Right. Hi Will Get denied For A Ral loan. Don’t Except To Get The Money Right away Normally It takes 6 Months To Receive His Return.. I Have Heard And Not A 100 % Sure It Is True But If The Ex Calls FMS And Gives Them Permisson To release The Money Earlier Then They May Send It To Your Wife Earlier. There Is Some Catches To This depending On his Filing Statues.
