Has anyone ever filed innocent spouse on their taxes before?
I am getting divorced and owe taxes from 2006. (We filed an extension and filed the 2006 taxes in late 2007.) The taxes are owed because of his income, not mine. My attorney suggested that I file innocent spouse to remove me from any tax liability. Has anyone ever done this and succeeded?

Federal Tax Question – Is it A Rental Property?
I inheritied my fathers residence in 2005 when he passed away. One of his requests was that his then girlfriend be allowed to remain in the residence rent free. The attorney that handled the estate setup an agreement that she would be able to remain in the house rent free for 5 years, she signed a lease, etc. The lease reflects $0 annual rental payments.
My question is can I still treat this property as a rental and take advantage of all of the tax benefits that accrue? I know there has to be an effort made to rent and there are issues if the rent charged is below the average rent for your area. Worst case I guess would be I can only deduct property taxes paid but not homeowners insurance, depreciation, etc…
Next question – I have recently paid said individual a sum of money and in return she has terminated the lease agreement and has moved out of the residence. Can I deduct the early lease termination payment I made to her from my income?
Any help greatly appreciated, thanks!

Attorney made error on Chapter 13 payments?
My husband and I filed Chapter 13 in 2006. Prior to that the attorney asked us to check if we would have a tax refund coming.
My husband found out that we would have a large tax refund coming. The attorney told us to adjust our tax allowances so that we would not have any refund. The reason was that any refund would go to the bankruptcy court. Our bankruptcy payments are based on the higher allowances. I was doing our federal tax filing last night when I realized that we now owe the government over $3000 in taxes because not enough money was taken out of my husband’s paychecks. We are barely making ends meet now. There is no way that we’ll be able to afford another $400 a month taken out for taxes. They are to base our payments with disposible income. I believe that paying our taxes is not considered disposible. Should I contact my attorney and ask for the payments to be readjusted? We are paying over $350 a week now. Last year, we paid over $18000 to the court.

Should I get an attorney to help settle my back taxes or should I work it out on my own?
I just received a letter in the mail from the IRS threatening to levy my assets to collect my back taxes. I have not filed my taxes for about 5 years, out of basically hard times over the past few years. My question is: should I try to work something out(payment plan) with the IRS directly or should I seek legal counsel. I am not sure if I would have the same negotiating power as an attorney would? I am also collecting unemployment right now. They are saying I owe somewhere in the neighborhood of 20-25k, which in actuality is much less, but I need to get my taxes filed to figure out how much I actually owe.
Also, I am getting ready to start a business with a friend of mine(50/50) ownership, but am kind of afraid for worry that they might be able to take the business away. Is this a possibility? It’s kind of a catch 22 because I need to start the business so I can make money to pay them but on the other hand, I’m afraid to start it because I’m afraid they might be able to take it, or all of the profit it makes, including my friend’s half. I could deal with them taking my half of the profit but if they take my friend’s half(not sure if they can do that?) he would not be pleased to say the least.
Thank you for your help

Do those commercials for attorneys helping people eliminate tax debt bug you like they do me?
They’re on all the time, and I just watched one with a woman who supposedly saved over $1.7 million in back taxes. Now, I don’t know about most Americans, but I don’t watch those things and go, Whooowee! That is awesome! I really hope and pray that the majority of what those people are eliminating is truly penalties and interest, because otherwise it sucks, and I think those people (who seem to be mostly business owners) should be paying their taxes just like everyone else. And here’s another thing I wanna know: From what type of funds are those attorneys being paid?? No doubt, they are making a nice little profit, like disability lawyers.

Question about raising taxes, how does one pay for the war without raising taxes?
The reason I ask this is because I know a Republican who frequents a local bar/restauraunt in my hometown he is Rep(he everybody else has their right for which party they support) but he thinks the Bush adminisrtation has done nothing wrong or illegal during his term he always complains if a Democrat would be elected, that they would raise taxes. He thinks Attorney General is doing a good job even though the Director of the F.B.I. contradicts him. How do we taxpayers pay for this war?
